You agree not to: use the Platform for any unlawful purpose or in violation of any applicable laws; submit false, misleading, or fraudulent information; attempt to gain unauthorized access to any portion of the Platform; use automated tools, bots, or scrapers to access or collect data from the Platform; reproduce, distribute, or create derivative works from our content without written permission; interfere with or disrupt the integrity or performance of the Platform; or use the Platform to harass, abuse, or harm others.

Account Responsibility

If you create an account on the Platform, you are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to notify us immediately of any unauthorized use of your account.

4. Attorney Referral Services

How Referrals Work

When you request an attorney referral through our Platform, we will share your contact information and case details with licensed personal injury attorneys in our network who practice in your state. These attorneys may contact you to discuss your case. You are under no obligation to retain any attorney referred through our Platform.

No Endorsement

Our referral of an attorney does not constitute an endorsement, recommendation, or guarantee of that attorney's services, competence, or qualifications. You should independently verify an attorney's credentials, experience, and reputation before retaining them.

Contingency Fee Arrangements

Most personal injury attorneys work on a contingency fee basis, meaning they only get paid if you win your case. Typical contingency fees range from 25% to 40% of the settlement amount. You should discuss fee arrangements with any attorney before retaining them.

Attorney-Client Relationship

No attorney-client relationship is formed by using this Platform or by receiving a referral. An attorney-client relationship is only formed when you and an attorney have both agreed to representation, typically through a signed retainer agreement.

5. Pre-Settlement Funding

Informational Only

Information about pre-settlement funding on this Platform is provided for educational purposes only. CrashSettlement.ai does not provide pre-settlement funding and is not a lender. We connect users with third-party funding companies who make their own independent decisions about funding applications.

No Endorsement of Funding Companies

We do not endorse any specific pre-settlement funding company. The funding companies listed on our Platform are independent businesses, and their inclusion does not constitute a recommendation. You should carefully review the terms of any funding agreement before accepting an advance, as fees can be substantial.

6. Intellectual Property

Our Content

All content on CrashSettlement.ai, including text, graphics, logos, images, data compilations, software, and the overall design and layout of the Platform, is the property of CrashSettlement.ai or its content suppliers and is protected by United States and international copyright, trademark, and other intellectual property laws.

Limited License

We grant you a limited, non-exclusive, non-transferable, revocable license to access and use the Platform for your personal, non-commercial use. This license does not include the right to reproduce, distribute, modify, create derivative works, publicly display, or commercially exploit any content from the Platform.

User Submissions

By submitting information through our Platform, you grant CrashSettlement.ai a non-exclusive, royalty-free license to use, process, and analyze that information for the purpose of providing our services. We will handle your information in accordance with our Privacy Policy.

7. Disclaimers and Limitation of Liability

Disclaimer of Warranties

THE PLATFORM IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE PLATFORM WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS.

Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, CRASHSETTLEMENT.AI AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, AND PARTNERS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, OR GOODWILL, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE PLATFORM, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

Maximum Liability

In no event shall our total liability to you for all claims arising out of or relating to these Terms or your use of the Platform exceed the greater of (a) the amount you paid us in the twelve months preceding the claim, or (b) one hundred dollars ($100).

8. Indemnification

You agree to indemnify, defend, and hold harmless CrashSettlement.ai and its officers, directors, employees, agents, and partners from and against any claims, liabilities, damages, losses, costs, and expenses (including reasonable attorneys' fees) arising out of or in connection with: (a) your use of the Platform; (b) your violation of these Terms; (c) your violation of any third-party rights; or (d) any information you submit through the Platform.

9. Governing Law and Dispute Resolution

Governing Law

These Terms shall be governed by and construed in accordance with the laws of the United States and the state in which CrashSettlement.ai is incorporated, without regard to its conflict of law provisions.

Dispute Resolution

Any dispute arising out of or relating to these Terms or your use of the Platform shall first be attempted to be resolved through good-faith negotiation. If negotiation fails, disputes shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association, except that either party may seek injunctive or other equitable relief in any court of competent jurisdiction.

Class Action Waiver

You agree that any arbitration or legal proceeding shall be conducted on an individual basis and not as a class action, collective action, or representative proceeding. You waive any right to participate in a class action lawsuit or class-wide arbitration.

10. Termination

We reserve the right to terminate or suspend your access to the Platform at any time, with or without cause, and with or without notice. Upon termination, your right to use the Platform will immediately cease. All provisions of these Terms that by their nature should survive termination shall survive, including ownership provisions, warranty disclaimers, indemnity, and limitations of liability.

11. Miscellaneous

Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and CrashSettlement.ai regarding your use of the Platform and supersede all prior agreements and understandings.

Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision will be limited or eliminated to the minimum extent necessary so that the remaining Terms will otherwise remain in full force and effect.

No Waiver

Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights. Any waiver of any provision of these Terms will be effective only if in writing and signed by an authorized representative of CrashSettlement.ai.
